If a person dies with a will, a will shall be probated to transfer title of assets. During the probate process, the named executor is given authority to act in place of the decedent, to manage, sell, and distribute the decedent’s property. The executor will be integral in closing or gaining access to bank accounts and selling real estate.

Legal counsel can be advantageous to executors in assisting in their duties and settling any claims against the decedent’s estate. The quicker you begin the probate process, the quicker the executor will be able to wrap up the decedent’s estate and transfer legal title to the beneficiaries.

If a person dies without a will, an estate administration may be necessary to properly transfer title of assets.
